1. Eligibility: The “Why I Love Viera” photography contest (this “Contest”) is open only to those who provide photography, taken in Viera, to the VieraPhotos@Viera.com digital address and who are 18 years of age or older as of the date of entry. Employees of The Viera Company or its affiliates, subsidiaries, or advertising and promotion agencies (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

2. Agreement to Rules: By participating in the Contest, you, as the contestant (“You”) agree to be fully unconditionally bound by the rules for the Contest set forth in this document (the “Rules”), and You represent and warrant that You meet the eligibility requirements set forth in Paragraph 1 above for the Contest. In addition, You agree to accept the decisions of The Viera Company as final and binding as it relates to the photos selected as winners of this Contest.

3. Contest Period: Entries will be accepted online starting on April 1, 2021, 8:00AM (EST.), and ending December 31, 2021, 5:00PM, (EST). (the “Contest Period”).

4. How to Enter: The Contest must be entered by submitting photos to the VieraPhotos@viera.com email address during the Contest Period. There is no fee required from You to enter the Contest. The entrant must provide signature waivers allowing The Viera Company to use all photos submitted for consideration. The topics for photos for the Contest are listed in each issue of the Viera Vision during the 2021 publication year. You may enter as many photos as You like into the Contest, but the photos must be taken in Viera, owned by You, contain photo releases for any individuals included in the submitted photos authorizing use of their image and likeness by You and The Viera Company for the Contest, and be a size of 1MB minimum to no more than 10MB maximum. If You use fraudulent methods or otherwise attempt to circumvent the Rules, your submission may be removed from eligibility at the sole discretion of The Viera Company.

5. Winner Selection and Notification: One (1) winner (each, a “Winner”) will be selected from each published topic for the Contest. Each Winner will be notified by The Viera Company by e-mail or by telephone. The Viera Company shall have no liability for a Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for a Winner’s provision of incorrect or otherwise non-functioning contact information. If a Winner cannot be contacted, is ineligible, fails to claim the prize within 5 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by a Winner of the prize offered in this Contest is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY A WINNER (AT THE VIERA COMPANYS SOLE DISCRETION) WILL RESULT IN THAT WINNER’S DISQUALIFICATION AS A WINNER OF THE CONTEST, AND ALL PRIVILEGES AS A WINNER WILL BE IMMEDIATELY TERMINATED

6. Prizes: Each Winner will receive a $100 gift card and a bag of Viera swag. Actual/appraised value of the “swag” may differ at the time of the prize award, but shall not exceed $100.The specifics of the prize shall be solely determined by The Viera Company. No cash or other prize substitution shall be permitted except at The Viera Company’s discretion. The prize is nontransferable by a Winner. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of each Winner. No substitution of the prize or transfer/assignment of the prize by a Winner to others or request for the cash equivalent by a Winner is permitted. Acceptance of the prize by a Winner constitutes permission for The Viera Company to use that Winner’s name, image, likeness, and entry (and the image and likeness of any other individuals that may be included in the photo of that Winner) for purposes of advertising and trade without further compensation to that Winner, unless prohibited by law.

7. Odds: The odds of winning the Contest depend on the number of eligible entries received.

8. Rights Granted by You: By entering this Contest, You understand and agree that The Viera Company, anyone acting on behalf of The Viera Company, and The Viera Company’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, your entry, name, photo, picture, voice, likeness, image, statements about the Contest, and biographical information (and the image and likeness of any individuals included in your entry photo) for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

9. Representation and Warranty by Contestant: By entering this Contest, You represent and warrant that your photo entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your photo entry infringes upon the intellectual property right of another, You and your photo entry will be disqualified at the sole discretion of The Viera Company. If the content of your photo entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless The Viera Company and its parent corporation, affiliates and subsidiaries and their respective officers, directors and employees (the “Indemnitees”) from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which any of the Indemnitees may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

10. Terms & Conditions: The Viera Company reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest prior to the expiration of the Contest Period for any reason whatsoever, as determined by The Viera Company in its sole and absolute discretion. In such case, The Viera Company may select a Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by The Viera Company to cancel, terminate, modify or suspend the Contest prior to the expiration of the Contest Period. The Viera Company reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates the Rules set forth in this document.

10. Limitation of Liability: By entering the Contest, You agree to release and hold harmless the Indemnitees from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) Your participation in the Contest and your acceptance, possession, use, or misuse of any prize or any portion thereof if selected as a Winner; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; and (v) electronic or human error in the administration of the Contest or the processing of entries.

11. Disputes: THIS CONTEST IS GOVERNED BY THE LAWS OF FLORIDA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, You agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in FLORIDA having jurisdiction. Further, in any such dispute, under no circumstances shall You as a participant be permitted to obtain awards for, and You hereby waive all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than your actual out-of-pocket expenses (i.e. costs

associated with entering this Contest). Participant further waives all rights to have damages multiplied or increased.

12. Privacy Policy: Information submitted with an entry is subject to the Privacy Policy stated on The Viera Company website at VIERA.com.

13. Winners List: To obtain a copy of a Winner’s name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: The Viera Company 7380 Murrell Road Ste. 201, Viera, Florida 32940 USA. Requests must be received no later than December 31, 2021, 5PM, EST.
